2025年2月25日に米国移民局（U.S. Citizenship and Immigration Services） は、14歳以上の在米外国人の登録制度を導入すると発表しました。この制度は2025年1月20日に発令された大統領令を受けて外国人在留者の管理を厳格化するものです。

過去に米国政府に指紋を提出していない30日以上の長期滞在者が対象になります。ビザ申請時およびESTA入国時に14歳未満だった方は指紋採取を受けていません。したがいまして、在米中に14歳以上になると登録義務が発生する可能性があります。導入までに詳細が発表される見込みですので、新たな情報が判明次第、詳細をお知らせいたします。

新制度の概要

• 対象者：指紋採取を受けずに、30日以上在米する14歳以上の外国人（※在米中の14歳未満の子供は、14歳の誕生日から対象者になる可能性があります。）

• 期限：入国または14歳の誕生日から30日以内

• 完了後：登録証明書が発行され、18歳以上の外国人には携帯が義務付けられます。

新制度の非対象者

すでにビザ面接や入国審査で指紋採取を受けた外国人は、再登録は不要と発表されています。主なカテゴリーは以下のとおりです。

• 米国永住権（グリーンカード）保持者

• 入国審査でForm I-94（在米資格証明書）を発行された外国人

• 移民ビザ・非移民ビザで入国した外国人

• 就労許可（EAD）を取得した外国人

移民局のX（旧Twitter）の投稿によると、「一部の特例を除くビザ申請時に指紋採取を受けなかった14歳以上のすべての外国人」が対象とされていますが、特例は具体的に明示されておらず後続の発表が待たれます。

【US Government Announcement】 Alien Registration Requirements

On February 25, 2027, the U.S. Citizenship and Immigration Services (USCIS) announced the establishment of a new process to enforce registration requirements for foreign nationals. This requirement mandate that all foreign nationals aged 14 and older in the U.S. apply for registration and fingerprinting. This measure is being implemented in accordance with an executive order issued on January 20, 2025.

The new requirement applies to all foreign nationals who have not been fingerprinted by a U.S. government agency and who stay in the U.S. for more than 30 days. Children under 14 at the time of their visa application or ESTA entry are generally exempt from fingerprinting. As such, if they turn 14 while staying in the U.S., they may be subject to the registration requirement.

Further details are expected to be announced before implementation, and we will provide updates as new information becomes available.

Overview of the New Process

• Who Must Apply: All foreign nationals aged 14 or older who stay in the U.S. for more than 30 days without prior fingerprint registration. (*Children under 14 may be required to register within 30 days of their 14th birthday.)

• How to Apply: To be announced by the U.S. Department of Homeland Security (DHS). In the meantime, they recommend creating a USCIS online account in preparation of the registration process.

• When to Apply: Within 30 days of entering the U.S. or within 30 days after turning 14.

• After Registration: DHS will issue evidence of registration, which all foreign nationals over the age of 18 must carry at all times.

Who Does Not Need to Register

Any foreign national who has already been fingerprinted during their visa interview or upon admission is considered registered, some of which include:

• Lawful permanent residents (Green Card holders)

• Nonimmigrants who were issued Form I-94 upon entry

• Individuals issued immigrant or nonimmigrant visas prior to arrival

• Holders of an Employment Authorization Document (EAD Card)

In an X (formerly Twitter) post, USCIS indicated that "All aliens 14 years of age or older (with limited exceptions) who were not fingerprinted or registered when applying for a U.S. visa and who remain in the U.S. for 30 days or longer" are subject to the requirements. The specifics of the exceptions have not been clearly defined, and we await further announcements.
