【米国政府情報】H-1B申請に関する大統領布告について/New Presidential Proclamation on H-1B Petitions

2025年9月19日（金）、トランプ米大統領は H-1B ビザ申請に対して 10 万ドルの手数料を課す大統領布告「Restriction on Entry of Certain Nonimmigrant Workers」 に署名しました。この布告は 2025年9月21日（日）午前0時1分（米東部時間）に発効し、有効期間は1年間とされています。
現時点では発効日以前にH-1Bビザを申請した方・許可を得た方には影響はないと発表されていますが、詳細がまだ不確定な点も多いため、不要不急の海外渡航はできる限り控えることを推奨します。 なお、 E ビザや L ビザなどの他の就労ビザに影響はありません。
現時点で公表されている大統領布告の適用範囲
新規申請時に課される一度限りの手数料である
発効日（2025年9月21日）以前に提出され現在審査中の申請、すでに承認済みの申請、または有効な H-1B ビザを保有している方は対象外
現在米国外にいるH-1B ビザ保持者が再入国する際、この手数料が課されることはない
H-1B ビザ保持者は、通常どおり米国を出入国することができ、その権利はこの大統領布告の影響を受けない
この手数料は次回のH-1B抽選（2026年3月）から初めて適用される (運用が変更になる可能性もあり)
ただし、トランプ政権下の移民政策は極めて流動的であり、今後、政府方針やその解釈が変更される可能性も否定できません。雇用主変更や滞在延長申請への適用可否などは詳細がまだ明確にされておらず、政府内の補足説明にも矛盾が見られるため、今後の動向を注視する必要があります。
大統領布告と政府の補足説明の経緯
当初は既存の H-1B 保持者にも影響が及ぶ可能性が懸念されましたが、その後のホワイトハウス報道官、米国移民局（USCIS）、および米国税関・国境警備局（CBP）による補足説明により、現時点での適用範囲は発効日以降に提出される H-1B 申請に限られることが明らかになりました。

大統領布告「Restriction on Entry of Certain Nonimmigrant Workers」は、H-1B 特殊職を申請する際、雇用主が 10 万ドルを支払うことを条件とし、この支払いがない申請については2025年9月21日（日）午前0時1分（米東部時間）以降、入国を制限するよう命じています。当初は、新規申請に限るのか、既存のビザ保持者にも適用されるのかについて明確な説明がなく、関係者の間で混乱と懸念を招きました。
USCIS および CBPによる補足（2025年9月20日付）
USCISおよびCBPは、この大統領布告は2025年9月21日午前0時1分（米東部時間）以降に提出された H-1B 申請にのみ適用されるとする補足説明を公表しました。具体的には、両局が職員向けに発出した内部メモにおいて次のとおり明記されています。
This Proclamation only applies to petitions that have not yet been filed. It does not impact aliens who are the beneficiaries of currently approved petitions, any petitions filed prior to 12:01 AM ET on September 21, 2025, or aliens in possession of validly issued H-1B non-immigrant visas.
（この大統領布告は未提出の申請にのみ適用されます。すでに承認されている申請の受益者、2025年9月21日午前0時1分（米東部時間）以前に提出された申請の受益者、または有効に発給された H-1B 非移民ビザを所持している外国人には影響しません。）

ホワイトハウス報道官カロライン・レビット氏は、公式 X投稿で、既に H-1B ビザを保有し現在国外にいるH-1Bビザ保持者が再入国する際には、この 10 万ドルは課されず、既存の H-1B ビザ保持者は従来どおり米国を出入国できると説明しました。さらに、今回の布告は新規ビザ申請にのみ適用され、更新や既存のビザ保持者には適用されないと補足しています。

New Presidential Proclamation on H-1B Petitions
On Friday, September 19, 2025, President Donald J. Trump signed a Presidential Proclamation titled “Restriction on Entry of Certain Nonimmigrant Workers,” imposing a new $100,000 fee on H-1B petitions. The Proclamation took effect at 12:01 a.m. Eastern Daylight Time on Sunday, September 21, 2025, and is to remain in force for one year. While it has been announced that the Proclamation does not apply to those who are beneficiaries of petitions filed and/or approved prior to the effective date of the Proclamation or are in possession of validly issued H-1B non-immigrant visas, many details remain uncertain. Non-essential international travel is therefore strongly discouraged at this time. The proclamation does not affect other employment-based visa categories, such as the E visa or L visa.
Scope of the Proclamation as Currently Interpreted
One-time fee required for new H-1B petition.
Petitions filed before September 21, 2025 (including those currently pending), approved petitions, and individuals who already hold a valid H-1B visa are not subject to the fee.
H-1B visa holders currently outside the United States will not be charged the fee upon reentry.
Current H-1B visa holders may continue to travel in and out of the United States without restriction.
The fee will first apply to the next H-1B lottery cycle (March 2026) (subject to change)
However, immigration policy under the Trump administration is highly fluid, and future changes in government policy or its interpretation cannot be ruled out. Questions also remain regarding the application of this fee to amendments such as employer changes or extensions of stay, and inconsistencies exist in supplemental government explanations. As such, it is critical to keep a close watch on further development
Background: Proclamation and Supplemental Government Guidance
Initially, there were concerns that existing H-1B visa holders might be affected by the Proclamation. However, subsequent clarifications by the White House Press Secretary, U.S. Citizenship and Immigration Services (USCIS), and U.S. Customs and Border Protection (CBP) have made it clear that, as of now, the scope of the proclamation is limited to H-1B petitions filed on or after the effective date.
Presidential Proclamation (September 19, 2025)
The Proclamation indicated that entry into the United States of aliens seeking H-1B specialty occupation status would be suspended unless their petitions were accompanied or supplemented by a $100,000 payment, and that any petition not meeting this requirement would be subject to the entry restriction effective 12:01 a.m. EDT on September 21, 2025. The Proclamation did not provide details as to whether this restriction applied only to new petitions or might also cover existing visa holders, leading to confusion and concern among employers and foreign workers.
USCIS and CBP Supplemental Guidance (September 20, 2025)
On September 20, 2025, USCIS and CBP issued internal memoranda clarifying that the Proclamation applies only to H-1B petitions filed on or after 12:01 a.m. EDT on September 21, 2025. They explicitly stated:
This Proclamation only applies to petitions that have not yet been filed. It does not impact aliens who are the beneficiaries of currently approved petitions, any petitions filed prior to 12:01 AM ET on September 21, 2025, or aliens in possession of validly issued H-1B non-immigrant visas.
White House Press Secretary Statement (September 20, 2025)
Also on September 20, 2025, White House Press Secretary Karoline Leavitt explained in an X post that H-1B visa holders who are currently abroad will not be charged $100,000 to reenter the United States, and that current H-1B visa holders may continue to depart and reenter the country as usual. She further confirmed that the Proclamation applies only to new H-1B visas, not to extensions or existing visa holders, and that the first implementation of the new fee is expected with the next H-1B lottery cycle (March 2026).
