【外国人登録制度】14歳未満でビザを取得した場合

2025年4月11日より施行された外国人登録制度に関し(参照:【米国政府情報】外国人登録制度の導入について)、米国移民局(USCIS)公式ウェブサイト上の自己診断ツールにアップデートがありました。これまで14歳以前にビザを取得した方の登録要否が不明瞭でしたが、14歳以降に入国審査で指紋採取を受けた場合は外国人登録が不要であると明示されました。
14歳未満でビザを取得し、米国内で14歳の誕生日を迎えた場合は外国人登録の対象とされていた。14歳になってから米国へ再入国した場合に外国人登録が必要かどうかが不明瞭だった。
14歳未満でビザを取得していても、 14歳以降に米国へ入国し、その際に指紋採取を受けている場合は登録不要
一方、米国内で14歳の誕生日を迎える場合は、誕生日から30日以内に登録が必要
事例①:14歳未満でビザを取得し、14歳以降に再入国して入国審査で指紋採取を受けた方
→外国人登録を行った場合 指紋採取は免除され、手続き完了通知(Courtesy Notice)が届く。※今回の自己診断ツールの更新により登録が不要であることが判明。
事例②:14歳未満でビザ取得 → 14歳になってからも出国せず米国内に滞在している方
→ 外国人登録を行うと、指紋採取の出頭通知が届き、指紋採取完了後に外国人登録証明書(Proof of Alien G-325R Registration)が発行される。

【Alien Registration】 Requirement for Children who Obtained a Visa Before the Age of 14
The U.S. Citizenship and Immigration Services (USCIS) has updated the self-check tool on its official website for determining whether an individual must register under the Alien Registration Requirement, which took effect on April 11, 2014 (See【US Government Announcement】 Alien Registration Requirements). The update clarifies that foreign nationals who obtained a visa before the age of 14 are not required to register if they were fingerprinted at a U.S. port of entry after turning 14.
1. Area of Uncertaingy Prior to the Update
Foreign nationals who obtained a visa before the age of 14 and turned 14 while residing in the United States are required to complete the alien registration. However, it was previously unclear whether registration was also required for individuals who obtained a visa before the age of 14 and re-entered the United States after turning 14.
2. USCIS Self-Check Tool Update
The updated USCIS self-check tool clarifies the registration requirements for individuals who obtained a visa before the age of 14.
If the visa was obtained before the age of 14, but the individual entered the United States after turning 14 and was fingerprinted at the port of entry, no additional registration is required.
If the individual turns 14 while residing in the United States, registration is required within 30 days of their birthday.
3. Example Scenarios
Example 1: Visa obtained before the age of 14 → re-entered the United States after turning 14 → fingerprinted at the port of entry
→ Under this scenario, once an alien registration is submitted, a "Courtesy Notice" indicating that the applicant is in compliance with the registration requirement is issued. Under the updated self-check tool, this scenario is now confirmed to not require registration.
Example 2: Visa obtained before the age of 14 → remained in the United States after turning 14 without departing
→ Under this scenario, once an alien registration is submitted, a fingerprinting appointment notice is issued, and after fingerprinting is completed, a "Proof of Alien G-325R Registration" is issued.
